Welcome to Gift Ideas App! By accessing or using our mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Gift Ideas App. By creating an account or using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into this agreement.

2. Description of Service

Gift Ideas App is a social gift-giving platform that helps you:

Create and manage personal profiles with interests and preferences
Connect with friends and family through friend requests
Track birthdays, celebrations, and important dates
Create and share wishlists with friends
Organize group celebrations like Secret Santa, birthdays, and holidays
Coordinate gift purchases by reserving or marking items as purchased
Discover gift ideas based on your friends' interests
Send and receive celebration invitations

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration and Security

To use certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Not share your account with others
Notify us immediately of any unauthorized access or security breach
Accept responsibility for all activities that occur under your account

We support multiple sign-in methods including email/password, Google, Apple, and Facebook. You are responsible for maintaining the security of your chosen authentication method.

Anonymous Accounts

You may use certain features with an anonymous account (guest mode), but functionality will be limited. Anonymous accounts may be automatically deleted after a period of inactivity.

4. User Conduct and Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Violate any applicable laws or regulations
Impersonate any person or entity or misrepresent your affiliation
Post false, inaccurate, misleading, or defamatory content
Harass, abuse, threaten, or intimidate other users
Upload viruses, malware, or any malicious code
Attempt to gain unauthorized access to the Service or other users' accounts
Scrape, harvest, or collect data from the Service using automated means
Use the Service for commercial purposes without our permission
Spam other users with unsolicited messages or invitations
Share inappropriate or offensive content
Reverse engineer, decompile, or disassemble the Service

5. User Content

You retain ownership of any content you submit to the Service, including profile information, wishlists, celebration details, and messages ("User Content"). By submitting User Content, you grant Gift Ideas App a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your User Content as necessary to provide and improve the Service.

You represent and warrant that:

You own or have the necessary rights to submit your User Content
Your User Content does not violate any third-party rights
Your User Content complies with these Terms and applicable laws

We reserve the right (but have no obligation) to review, monitor, or remove User Content that violates these Terms or is otherwise objectionable.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

Sharing with Friends

When you connect with friends on the Service, they can see:

Your profile information (name, username, birthday, interests)
Your wishlist items
Celebrations you participate in together
Your profile photo

By adding friends and joining celebrations, you consent to sharing this information with them.

7. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Gift Ideas App and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

Copy, modify, or create derivative works of the Service
Distribute, sell, or lease any part of the Service
Use our trademarks, logos, or branding without permission
Remove or modify any copyright, trademark, or proprietary notices

8. Third-Party Services and Links

The Service may contain links to third-party websites, services, or products (such as shopping links on wishlist items). We do not endorse or assume responsibility for any third-party content, services, or products. Your interactions with third parties are solely between you and the third party.

We use third-party services including:

Firebase (Google) for authentication, database, and storage
Cloud hosting providers for infrastructure
Analytics tools to improve the Service

These third-party services have their own terms and privacy policies, which we encourage you to review.

9. Payments and Purchases

Premium Subscriptions

Gift Ideas App offers premium subscription services through in-app purchases (IAP) that provide access to enhanced features and functionality. Subscriptions are available for purchase through the Apple App Store and Google Play Store.

Subscription Plans and Pricing

We offer the following subscription plans:

Weekly Subscription: Approximately $3.99 USD per week (pricing may vary by region and currency)
Yearly Subscription: Approximately $34.99 USD per year (pricing may vary by region and currency)

All subscription plans include a 3-day free trial period. During the trial period, you will have full access to premium features. At the end of the 3-day trial period, your subscription will automatically convert to a paid subscription unless cancelled before the trial expires.

Auto-Renewal

IMPORTANT: Unless you cancel your subscription before the end of the current subscription period, your subscription will automatically renew. This means:

Weekly subscriptions will automatically renew every 7 days at the weekly subscription price
Yearly subscriptions will automatically renew every 12 months at the yearly subscription price
Your payment method will be charged automatically at the beginning of each renewal period
You will be charged the price that was in effect at the time of your initial subscription purchase
Subscription prices are displayed in your local currency at the time of purchase through the App Store or Play Store

By purchasing a subscription, you acknowledge and agree that your subscription will automatically renew and you will be charged unless you cancel your subscription in accordance with the cancellation procedures described below.

Cancellation

You may cancel your subscription at any time. To cancel your subscription:

iOS (Apple App Store): Go to Settings → [Your Name] → Subscriptions → Gift Ideas App → Cancel Subscription
Android (Google Play Store): Go to Google Play Store → Subscriptions → Gift Ideas App → Cancel Subscription

Important: You must cancel your subscription at least 24 hours before the end of the current subscription period to avoid being charged for the next period. If you cancel during a subscription period, you will continue to have access to premium features until the end of that period. You will not receive a refund for any unused portion of the subscription period.

Cancellation must be completed through your device's App Store or Play Store settings. Gift Ideas App does not process subscription cancellations directly. If you have difficulty cancelling through the App Store or Play Store, please contact their respective customer support.

Payment Processing

All subscription payments are processed by Apple (for iOS) or Google (for Android) through their respective in-app purchase systems. Gift Ideas App does not store or have access to your payment information. Payment processing is subject to the terms and conditions of Apple App Store and Google Play Store.

Refunds

Refund requests for subscription purchases must be directed to Apple (for iOS) or Google (for Android) through their respective refund policies and procedures. Gift Ideas App does not process refunds directly. Refund eligibility is determined by Apple and Google's policies, which may vary by jurisdiction and circumstances.

Price Changes

We reserve the right to modify subscription prices at any time. If we increase the price of a subscription plan, we will notify you at least 30 days in advance. If you do not wish to continue your subscription at the new price, you may cancel your subscription before the price change takes effect. Price changes will not affect your current subscription period but will apply to subsequent renewal periods.

Free Trial Terms

The 3-day free trial is available to new subscribers only. If you have previously used a free trial or subscribed to premium features, you may not be eligible for additional free trials. Eligibility for free trials is at our sole discretion.

Subscription Features

Premium subscription features may include, but are not limited to, enhanced functionality, additional storage, advanced features, and priority support. We reserve the right to modify, add, or remove features available through subscription plans at any time with reasonable notice.

Regional Pricing

Subscription prices are set by Apple App Store and Google Play Store and may vary based on your location, local currency, and applicable taxes. The exact price in your currency will be displayed before you confirm your purchase. Prices shown in this document are approximate USD equivalents.

Third-Party Purchases

Links to external shopping websites are provided for your convenience. We are not responsible for any purchases you make through third-party websites. All purchases through external links are subject to the terms and policies of those websites.

10. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the Service will be uninterrupted, secure, or error-free
Warranties regarding the accuracy, reliability, or completeness of any content

We do not warrant that:

The Service will meet your requirements or expectations
Any errors or defects will be corrected
The Service is free of viruses or harmful components
Your data will always be available or will not be lost

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GIFT IDEAS APP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Business interruption or loss of goodwill
Cost of substitute services

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising out of or relating to the Service shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Gift Ideas App and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Your User Content

13. Account Termination

Termination by You

You may delete your account at any time through the app settings. Upon deletion:

You will have 30 days to recover your account by logging in again
After 30 days, your account and associated data will be permanently deleted
Some information may be retained as required by law or for legitimate business purposes

Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe:

Violates these Terms or our policies
Harms other users or the Service
Exposes us or others to legal liability
Is otherwise inappropriate or objectionable

We are not liable to you or any third party for any termination of your access to the Service.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by:

Updating the "Last updated" date at the top of this page
Providing an in-app notification
Sending an email to your registered email address

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and may delete your account.

15. Dispute Resolution

Informal Resolution

If you have any dispute with us, please contact us first at support@giftideasapp.com so we can try to resolve it informally.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Arbitration

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
